Respected Lawyers,
1. Place of Marriage, Kurukshetra (Haryana) in 2007.The couple then reside in Aligarh (UP). Wife leaves Husband after 3 months and stays with her parents at Faizabad (UP).Wife lodges complaint case against Husband & In-Laws in local courts,Faizabad. Summons never reached the husband, finally NBWs were issued against the family.Husband moved high court (UP) for quashing of Criminal Proceedings.Advocates opine that the case will be referred back to trail court (Faizabad) for further proceedings.
Q- 1.What are the merits of the case basis which HC passes judgements in such cases?
2. Since the place of crimes cited is outside the place of territorial jurisdiction, can the husband file transfer application in High Court?
3.In case the HC directs bail on same day. But since the husband doesnot know anyone in faizabad, can sureity bonds (money) be an alternative to guarantors??
