RESPECTED SIR,

My husband had put case for divorce in 2009 against me.During the case we file act 24 against my husband due to which judge put maintenance of 1000 per month against my husband and to give fees of lawyer which cost Rs.1500(only once).After 3 months they submit no money for maintenance.Then we put the application in the court for the money to deposit of maintenance and said that no case must me run until my husband submitted money.Then judge take action against that application and said orally to lawyer of him that if you deposite no money than your case will be discarded.Then they submitted the fake application that we have submitted Rs.1000.

WE cant want to run this case forward until my husband submitted money of maintenance.

SO please pprovide us guidence related to-

(1).What we can do against him.

(2)what action can be taken by judge by his lie application

you file execution application for attachment of salary/ property of your husband. you may also file an application that the case of divorce cannot proceed until and unless the maintenance is paid to the lady

Your application is right. His case cannot proceed until he has paid the maintainance u/s 24. If he submit an application saying that he has paid it he will have to prove the payment. Oral submission is not going to make any difference. Meanwhile you may start taking the future maintainance without prejudice to your rights.
