respt. lawyer. myself uttara from chennai. ma hubby is in TCS, banglore. problm is that he wants divorce. we are lvng sprtly for last 3 yrs. now i want to ask, his salary is 1,80,000 per month n mine is 40,000 per month. can i claim for self maintnce?
m living with aged parents. altho' dad is retd from railways, and gettng pension 14000 per month. can this thing will effect to incrse my maintnce?

you are entitled to maintainance to maintain as per status you enjoyed before seperation. Your parents pension cannot be included. On the other hand you have a right of residence under domestic violence act. you have not mentioned if the divorce petition has already been filed against you.
