does refusal by wife even after 3 months after her maternity which she left her husband home 7 months before giving birth to a child to come back to her martrimonial house without any reason or having intention to take her husband to live in her birth town permanently ground to file a restitutional case.

You can file for restitution of conjugal rights before the court asking your wife to join you.
