Legal Question in Family Law in India

i have know that i have rights to get my grandfather property but my mother is not willing to get share her 's father property because of status. my grandfather no more and my grandfather expired without will. my mother sibling are 1brother and 2 sister. right now my uncle is using all the properties which is earned by grandfather. my question is can i have right to file a suit against my uncle to get my share on properties?

Yes, you are entitled to claim your share as a legal heir since the property is ancestral.
