Legal Question in Family Law in India

senthil

Ours is a Hindu registered marriage

After 4 weeks of marriage i went to US. After 6 weeks she took a u-turn and demanded a divorce for a minor quarrel over the phone.

Now she has sent a divorce petition without any mention of dowry/abuse and is demanding 15 lakhs.

In her petition she has lied by stating that she had informed me through her parents that she asked for a divorce on the third week of marriage and she has supplied many wrong things about me and my health.

I have filed restitution as i am interested in re-union. But she adamantly is demanding separation

Given the fact that the court cannot force her to live with me, i want to know whether i can prosecute her for supplying false info to the court. Will this be treated as perjury on her part as she had covered up all the emails sent by her expressing love and affection after the date mentioned in the petition as the date on which she decided to pull out of the relationship.

She had also sent SMS stating that she loved me on end Oct'07(i.e after the date of separation mentioned in her petition)

I like her, but if cheats me i will teach her a lesson

Will the court treat this as a case fit for perjury?

Re: senthil

(a) There may not be a case for prosecution on the alleged "supplying false info"; should not consider this option;

(b) No, this may not be covered within the meaning of "perjury";

You are blowing hot and cold; if you love her and like her, try to repair her injured feelings and bring her back into your life. The carrot and stick policy may not work; be firm and repent for your mistakes; a food-hard, false egoistic stand may bring you more trouble.
