we are separated now and his father threatens me that you will receive a court notice soon, but my wish is to live with my wife in my place, and if they send a notice to me how should i react and whether can i take my daughter back, as my wife had a brain tumor operated and consuming medicines still, knowing this i married her, how to take my daughter back is that possible, my daughter is just a 9 months old now

if you still want to live with your wife, you may file a case for REstitution of Conjugal rights and seperate file a case for custody of daughter. Normally a child is to live with mother for first five years of life, but, in this special case of mother having brain tumor surgery and health conditiions
