Legal Question in Family Law in India

I am separated from my husband and have filed a divorce, maintenance and custody case in Chandigarh. The child is 2.8 years old. How quickly can I get custody of my child ? My husband is avoiding maintenance and the in-laws have filed false police complaints against our family to make it difficult for us.

where is the child staying? did u file a petition for custody before the guardianship judge or filed a Domestic Violence complaint.

in case the husband is avoiding maintenance, you may claim the same by filing a complaint under domestic violence act and also file a complaint under 125 crpc.

Is the child with you? Have you filed for the custody of the child?

Have you got any orders for maintenance. If yes and still he is not paying maintenance then request Court to issue warrant/recovery warrants against your husband.
