Is signing a divorce deed good enough for the boy and girl to marry elsewhere without waiting for the decree?what if one side doenot cooperate for the decree??can the other get the decree exparte based on divorce deed??R there any past court orders in india pertaining to similar casess??

Dear Friend,

Please understand as follows

- One cannot consider his marital status to be of "Divorced" simply by signing the so called "Divorce Deed".

- To seek a divorce under mutual consent a petition needs to be filed in respective court to seek decree from the court.

- AFter getting a decree only one can marry somewhere else not otherwise.

- One year is time for re-appeal from the date of decree and hence it is suggestiable to not to marry for next 365 days after receipt of decree from the court.

- If any one of the spouse want to withdraw from the association of marriage, he/she can do so only through the court only and not otherwise.

- Ex-Parte divorce not possible,
