According to me no matter what ever be your cast or customs. But in order to have divorce you have to approach the court and obtain a decre of divorce. getting a divorce settlement made before a notary is not valid and has got no legal sanctity in the eyes of Law.

Customary divorce is acceptable in law provided the custom and caste are duly recognised. You may refer to RATTIGAN'S DIGEST to understand recognised customs in India.
