Sir Im David Kumar, My Wife Is Ready To Hand Over The Minor Son Aged Abot 1 Year To Me,But She Needs Divorce, An Im Ready To Give, She Has Found a Lawyer, What Child Custody I Should ask Her To Mention In Paper, An In Our Marriage Invitation My Name Is Mentioned as Santhosh (Pet Name ) In Hindhu Marriage Act, But When She Files Matter My Name Will Be David Kumar Thats My Document Name. An My Child's Birth Certificate Father Name Is Right As David Kumar, Only The Problem Is Marriage Invitaion Which Is Mentioned As Santhosh,Will The Court Accept This, an Can She Mention Visitation Rights If She Wants, An Can I Say NO To Her Visitation Rights Only On Paper By Law, Pls Answer My Queries,Shes Scared To Fight FOr The Child Coz Shes Caught With Me, An She was Leading An Adultres Life Wth @ Men Outside Family, So She Itself Came Up an said Tht Give Me Divorce Jus take your son, an I have all Proof Of what all She did. What Child Custody Should She Mention On Paper, ??

You dont have to mention any thing in the Divorce petition but write that your wife has agree to give the custody of the son to you without taking any visitation right for herself. No such evidence is needed to proof the marriage till any party dispute the validity of marriage.

As per your condition file a consented divorce with the clause that the custody of the child will remain with you and mother will not have any visiting rights.
