Sir , Should We Draft Sayeing Tht Me an my Wife Lived Seperatly For a 1 Year, Both Us Has Made a Decision To End Our Marriage, An We Are Going For a Mutual Constent Divorce, But We Lived Seperatly Just For 2 Months,The Guess The Law Says To File For a Mutual Constent Divorce Husband an Wife Should Have Lived Seperatly For 1 Year, An What Custody I Should Ask For My Son, Shes Ready To Hand Over The Baby, But i Dont Want To Show My Baby To Her, An What Happens If we Both Dont Attent Counselling. Answer Me ..

With regard to your sons custody , if your wife is not taking it and you have mentioned in your petition then it is fine for the court to grant you the same.
