Sir i have filed for Restitution of conjugal rights and in the stage of cross examination now ...and still not cross examination done , and now 2 weeks before my wife side lawyers have filed for divorce ...in the same court and asking for a number

Whether my wife can file a divorce petition when already i have filed RCR and still order not given running in court

Sir please help me how should i react to this .... if judge accept their divorce application please help me ....

Your RCR and your wife divorce petitions will have to be studied to advice. It does seem that you are on a stronger wicket as your wife had not applied for divorce and seem to object only now perhaps as an after-thought. For more specific advice you may contact with papers. [email protected]

yes she can file divorce during RCR proceedings but you and your lawyer can defend (contest) Divorce case.

she can file a petition for divorce even if you have filed RCR. both the reliefs are contrary and mere filing does not mean that divorce would be granted.
