Legal Question in Family Law in India

hello sir v r in problm.....actualy my father is nt a good persn...., v r one sister and two brothers, im 21yrs old my sis 22 nd youngr brothr is 19...., till now my father beats my mother, create problm in house...., bt last week...v al brothr sister were nt in d house..., nd my father beatsup my mother so rudely.....
nw situation is so bad...., we want to separate...cuz....my father cnt change...nd we want a happy nd safe life..., im pursuing my BCA nd into my final year, sister pursuing B.Sc nursing hons. at AIIMS.., my brother is in KMC delhi univ......
my mom is taking tutions, nd we hv one paying guest..., i knw v r going to face problm relatd to money..., i just wanna ask u sir..., "If my mom file divorse against my father...is ny financial support vl b given to us frm him...???"
.......he is nt doing nything....acc to d standards..., bt in real he is working at noida DDA authority..., he is there just because of a uncle of mine...he is nt a govt employee, bt sits in dat office nd earn so around 50-60 thousands per mnth..., plz help me sir...otherwise i hv to do a job for my family.....im waiting... im from Delhi, India

Yes you mother can file for divorce and claim maintenance ... and he shall be liable to pay her maintenance...she can file petition on ground of DV and cruelty...
