Sir, my wife has filed a complaint in the woman cell for 498a and paralleley also filed DV under sections 18,19,20,22.
Sir, my father has two properties in delhi, both acquired and not ancesteral, i being a defence employee in my short service carreer till date only have a car on my name and my salaried amount, more so i had filed RCR before and as a retaliation got hit with 498a, can you please elaborate as to the point that do i / my father who since our marriage were never residing with us because i was never posted in delhi need to part with any property. Also why the compensation and maintenance isasked in DV since i have already stated that want her back

your wife has no right in the property owned by you or your father and cannot seek any share in that. at the most, under DV act, she can seek restraint orders that you do not relinquish your share in the property of your father and she can seek other remedies under DV act. she can also seek the residence orders at the place where you are staying. is there any child involved? a good lawyer would bail you out of this situation without much damage.
