Legal Question in Family Law in India

Sir,

Here my female friend is petitioned 498,294,34, behalf of her husband,and in court her husband blamed her that she is a characterless woman,but she deny that sentence in court ,that 498 case is continued since 1and half year,but justice not find,she is very disturbed about that, she want divorce, but some advocate says if 498 is running so don't give divorce to him,

I want to know that if she will give divorce so what happens in 498 case, and if she is able to give divorce or not give me all processor,

kindly give me suggestion.

it is wrong to say that till 498a is pending, divorce cannot happen. both are different laws and your friend needs to file a petition for divorce on the ground of cruelty and in case she wants early divorce, she may negotiate with her husband and file divorce by mutual consent.
