Legal Question in Family Law in India

Sir,
I met my husband through social networking site and he met me after couple of months and decided to get married with parents concern.We belong to same community and we are distant relatives.Slowly after engagement they started demanding dowry.My parents gave 10lakhs cash to my in laws hands and 5 lakhs worth gold during marriage .My inlaws were not happy with dowry and they made big quarells after marriage ,on the day of marriage.later they started comparing with others n verbally harassed me.After 3 weeks of marriage we came to US ,there he started abusing me phyisically and mentally.He used to threaten me like he will be calling police on wrong allegations.He even called police and i have replied them that he is in short temper and then he realised that nothing is going to happen with cops and he started threatening me he will give divorce..we ve been married for 1 year 3months.Due to this stress my health got damaged and 2months back ive been diagnoised am diabetic at age of 25,he took all money from me and i dont know any one here not even his freinds or colleagues and am on H4 dependent visa.He wants to get rid of me , he is not bothered of my medication.what kind of steps i can take.Me and my parents went through lot of mental trauma.He wont speak to any one ,just open pc and do his work,no love and affection,its love turned arranged,the day we got married from that day he's been sadistic and my inlaws insulted me and my parents like any thing and it still going on.i tried lot to fix up things but it all went vain and resulted in lot of stress.I am a engineering graduate not working.He is blackmailing me to put sign on divorce papers,then only he will be send me to India and he wants to stay in US,and what kind of justice i can expect ???????if i leave to india is it going to be safe?I want to solve and face legally in Andhrapradesh,India

Your sufferings are very unfortunate. Firstly, you must file a police complaint in USA immediately for domestic violence and physical abuse and also state the possible consequence at home in case your husband comes to know about your complaint. Thereafter, speak with your husband through your lawyer/ relatives after your return to India. Make a complete list and proof of all dowry items given and possible diary noting of all acts of physical violence by him.

See if you can live separately in US after speaking with your employer for sponsorship. Once you return to India ( Since you are on H4 VISA), you can take appropriate legal steps for justice. [email protected]

in your situation, i advise to fight it out and stay there in US. you are an engineer and can secure a good job in US. try n look for a job and start earning. most of your problems would be over once you become financially independent. secondly, if he ignores you or is indifferent towards you, this is no crime. in case he inflicts physical or mental cruelty, then you may seek help by dialing 911. the latter situation should be avoid as far as possible. go ahead n start working. in case you are not able to work due to health reasons or due to being dependent, you may seek legal help and claim spousal support.
