sir
i have section 9 a ex party order degree. i also won my crpc 125 case as she refuse to join her matrimonial home. after getting section 9 a ex party order degree, a period of 3 year is over. now i am going to file divorce under section 13a. now my question is.
Q1 if i got divorce from my wife, can she is liable to get maintenance under any section? keep in mind that she loose her crpc 125 case previously.
Q2 if your answer for the above question is yes, then under which section she can claim maintenance?

SIr, she can file 125 of crpc again and she can even file application under section 25 of hindu marriage act where she can be awarded maintenance, further there are supreme court decisions where the court has passed judgments stating that a divorced wife is entitled for maintenance.
She wife will not get any maintenance after Divorce. She can can claim Alimony at the time of Divorce and the court will grant her Alimony.
