Legal Question in Family Law in India

Sir/Madam,

My sister marrid in 2002 having ons son and is working in Junior College Non grant. Her monthly income is up to 7000/Month.She is also taking private tution in evening to get additiona financia support.She is paying all the expences and need for Her Son start from School uniform , School fees (Upto 15000/year), Book tutuin fees,etc and all daily needs & Expences

Her husban is not giving any financial support to her. he is also working in junoor college (Non grant) and saying tha child is not my responsibility and you are also working so i am not accountable to pay you for your daily needs.

I wnat to know waht legal action we can take against her husband.

You can file a maintenance case both under Hindu Marriage Act as well as under Sec 125 of CrPC. Your husband can't escape the responsibility. You will certainly succeed. THANX

the father is duty bound to maintain his son till 18 years of age and even after that he is bound to support him in his studies. you may file a petition u/s 125 of criminal procedure code.

IF u r earning, then it may also create some problem in maintenance for you but first of all file case in the name of your son and demand maintenance for your son. Then take another steps.
