Legal Question in Family Law in India

Sir,my husband is forcing me to have divorce.Ours is a combined family soalong with him in-laws n sister in law harassed me a lot.mediators as well his family members too tried to work out in convincing him but he is blackmailing that he will commit suicide.iam not interested in divorce at all cos he willingly married me and now if he says i dont want how can i leave as its a matter of my life.from 6 months iam staying away with him can he take advantage and file a divorce petition?if i say no to divorce and stay seperate untill he accept me will it be possible without any problem with him

There will be no problem for you to stay separate. However, you should continue making efforts and keep writing him about your willingness to join the matrimonial home.

There is a possibility that the law may be amended in the near future incorporating the ground of "irretrievable of marriage" as one of the grounds for divorce. If that happens, possibly, three years separation may be a ground for divorce.

Therefore, you should not delay this matter. If there is no chance for conciliation, it is better to reach an amicable out of court settlement and arrive at a compromise. If divorce is inevitable, you should prepare yourself for that eventuality instead of an endless wait.
