Legal Question in Family Law in India
sir,
My son age 2 1/2 years my husband not looking or
not maintening nor paying school fee. He is
showing that he is labour but actually he is maintening
one poultry farm on his mother's name due to agriculture
there is no proof for the above. Can my son directly put
case against his father without attending to court due
to small boy (can lawyer attend and the case will be allowed).

Your son being a minor cant approach the court directly. Instead why dont you file a case for maintanance against your husband and ask for the maintanance for your self and also for your son.

Yes, your son is entitled to file a case against his father through you as the next friend / guardian seeking maintenance. You are also entitled to file a case directly for yourself and your son. You both may be entitled to maintenance as per his standard of living without any proof of income.
