my sister expire on 04.08.09 after delivery a female child thereafter her husband and his family members they not agree to meet us with her child. soon after 10months on 28.05.2010 her husband get merried again. we all are worried about her child's future. we want custody of that child because we not trust her father and step mother. can we take her custody right legally. please provide the legal path

In your case, first right on female child is of father only.

First right is of father but you can demand the right coz he remarry and if court did not allow then you can demand visiting rights so that atleast you can keep an eye.
