Hi, My sister has 3 year old child, and she had left her husband house 4 months back due to confilct, now her in-laws and husband are refusing to hand over her child to my sister.
What she should do now.? please advise

under hindu law, up to five years of age of child, mother alone is entitled to child custody. you may simply file an application under guardian & ward act for permanent custody of the child. along with that an application for interim custody or interim arrangement of visitation of child as the child is only 3 yrs.
You will have to add up some ground also that you can take better welfare of the child as compared to your husband and the environment there.
File an application before the Guardianship Court under G.W.Act read with the H.M.G.Act.
