What to do at this situation
I were married after 12 yesrs of our courtship, stayed for 1 year in a home, next year my wife went to USA. When she was going to USA, I were not able to go because of my own problems. She went there and stopped any communication with me, God knows what happened there. I went to her home, her mother told me that I should forget her, she is no more my wife. Later I came to know that it was all plan of her greedy mother who always wanted money from her and brainwashed to leave me and to go to USA for a better life. Before going, I was asking her to go for court marriage, to get visa for me in future, she always postponed that and told me that she will be coming after one year then we will get it done. She nver came back and it is three years now. I want to ask you people, if she has not provided the real information about her marriage to US consular to get visa, can it be taken as an evidence that she intentinally did it to desert me. I suspect she has gone on unmarried visa. How can I get this information from US embessy when I dont have any legal certificate except photographs? The next question I want to ask how should I proceed for my divorce?

The entire case is on imagination only and no proofs for what you are telling except that you are having marriage photograph.If your wife would have gone on unmarried visa you should have proof of marriage to counter that.
you can file divorce petition here in india and summons will be sent to her if you are having correct address of her. If she neglets that you will get a exparte decree,which will be absolute after 90 days from date of order and you can remarry that is all you can do. You can infrom the US authorities with the divorce petition copy that she is a married women. It will be enquired and there also she may tell that she is unmarried.
it is better to get atleast an exparte decree of divorce at least for you to come out of this problem. if necessary contact me. regards
