Legal Question in Family Law in India

I want to ask a small question that my friends wife filed a fraud 498A and 307 case on their family now question is judge of session court framed charge under 307 section as in her statement/ fir she used to say that my friends family member poured kerosene oil on her but in medical report no info for same so they moved high court u/s 482 and got order in their favor and high court set aside order of lower court and asked to frame charge again.

now my question is weather judge can frame the charge u/s 307 again or not.
