Can me or my son claim rights in property in the name of my mother-in-law

Due to extreme torture, cruelty and dowry demands from my in-laws, I left my matrimonial house and am staying currently with my parents. I have a baby boy also. The House in which I was staying belongs to my mother-in-law and not my husband. She got it some years back from DDA. Can I or my son have any rights in that property. If Yes, how and when can we claim that ?

Me and my HUsband were staying in that house only along with my mother-in-law for more then 2 Years

Your facts are insufficient for determining your legal rights.

As such you or your child may have no legal right in the property of your mother-in-law. However, there may possibly a way out, if only you find out the source of funds which were utilized in purchasing that property. If the property was purchased from the funds of your husband or his father, you or your child may possibly claim a share in the property.

You may better pursue your remedies under the Domestic Violence Act and/or 498-A/406 IPC.
