Legal Question in Family Law in India

Special Marriage Act Date-Mid June,2011,Social Marriage Date-Mid December,2011.As the girl was a working lady at a place other than the boy's place of working/living the couple started living together from March,2012 after the girl's transfer.HOWEVER THE GIRL COULD NOT RECONCILE AT ALL AND DESERTED THE BOY ON HER OWN WILL FROM END OF MAY,2012 and since then they are living separately at their respective place .They have now decided to file a case for Mutually Consented Divorce(not yet filed)My question is

HOW SOON THEY CAN FILE THE CASE IN CONSIDERATION OF THE FOLLOWING

A)One Year after the Marriage Registration Date ie mid June,2011

OR

B)One year after the Social Marriage date ie mid December,2011

OR

C)One Year after the date of desertion ie end May,2012

Question No-2

After the divorce case is filed,BUT BEFORE THE DECREE OF SEPARATION IS OBTAINED(in consideration of cooling period)whether the boy's guardians(not the boy himself) can advertise in the paper as follows

Text(IMPORTANT)- *Marriage for Name's sake.Mutual Divorce Applicant Boy.Negotiations desired from the girl'party.Marriage in due time"

Here the question is BEFORE GETTING THE DECREE OF SEPARATION whether the boy's guardian can PUT UP SUCH AN ADVERTISEMENT.

With thanks

You can file a divorce suit after one year from the date of the separation.if file a advertisement before getting a divorce then you may face criminal case under IPC.
