Staying separate

I got married in Nov 2005, due to some confusion we both stopped staying togethers and she continued with her studies. After 1 1/2 year parents asked us to start living together and it will be close to a year that we are staying together; however, we do not have healthy relationship. Now we have decided to give it a chance for a month to live a normal life but decided that in this months time if it does not work out we will give ourselves anywhere between 6 months to 1 year and live separate. During this period we will decide whether we can live with each other or not. More of less I must say that confusion was created from her end but it effected me and I am not comfortable with the relationshop of staying together. I made her understand this, she accepts her mistakes and is ready for mthis call. What all formalities are required from our end so that tomorrow her family of my family cannot file a law suite. Please suggest..

assuming both of you are Hindu governed by the Hindu Marriage Act; and you are in India:

You will need to provide her damages for the loss suffered in marriage; besides, you will be required to make arrangements for her alimony.

after all financial arrangements are made, you may seek divorce by mutual consent.

As such no formality.However,you both may enter into MOU.
