Streedhan
My borther has decided to part ways(mutual divorce) with my sister in law due to differences and due to the fact that she is carrying on an extra marital affair. What I would like to know is if the jewellery that was given by my parents and my relatives to my (ex)sister in law could be claimed by her as part of the ''streedhan''. At the onset, their family was ready to have a mutual seperation wherein we decided to give all the gifts she received from her family members and they agreed to return all the gifts that were given by ''our'' family members. Now the girls family is claiming to keep all the jewellery under streedhan,which we(from the grooms side) gave to her as she has the possession of the same. Is there anyway to claim the jewellery that was gifted to her from our side of the family since we're ready to give her all the things back which were gifted from her side of the family during marriage. Any help/advice in this regard will be much appreciated.

The girl family is rightly demanded entire "istridhan". whatever was given to her by any of the family members, including her husband and in-laws, belong to her. She may even register a criminal case u/s 406 and 498-A IPC if you refuse her any part of her 'istridhan'.
Advice : settle the dispute amicably and urgently before they go to the police and lodge a complaint against you guys.

It is her Streedhan and she has all the right over it. See that the mutual consent Petition is filed at the earliest, as she can also file a dowry harrasment case aginst your family members.

The girl's family is right. I would advise you to give her belongings which is streedhan or else criminal proceedings u/s 498-A can be done.
Do it as soon as possible to avoid any troubles.

when ever your family gifted that property to your sister in law then it is her property you cannot cliam the same in law.
