Legal Question in Family Law in India

technical question...

wife discloses after marriage that she was not interested in marriage, however was forced for the same by her own parents against her will, the marriage is not consummated & yet not even an year has passed .....in such case under what section of nullity can the husband file to get it annuled and declared as null and void....kindly reply...can anyone provide some judgements of family courts on nullity....

in case the wife is disputing the fact that marriage was not consummated, its almost impossible for you to prove her wilful refusal of the same. its better u convince her for divorce by mutual consent in case she is not willing for nullity.

You may consider filing a mutual divorce petition under section 13B of Hindu Marriage Act, 1955.
