Re: time frame to file petition for void marriage

The meaning of the word "fraud", as used in Hindu Marriage Act, 1955, is commonly misunderstood by ordinary persons.

Therefore, to ascertain if your case may possibly be covered within this law, you may first explain the facts may be the basis of your allegation of fraud.

The importance of the word "fraud" limited to obtaining consent of a person for marriage. Suppose a fact is discovered after marriage as incorrect, but it can be established from attendant circumstances that the person would have married even if the correct fact now discovered was known to him/her, then the so called 'fraud' will not be sufficient to seek dissolution of marriage.
