thank u all for the valuable answers court is having vacations and we are under going out of court settlement, is it necessary that we have to withdraw the case on the date of hearing ?actually the withdrawing party is my former husband. and there is a pending of F.C.A in Hon'ble High Court? for the settlement i want him to withdraw all the appeals in the Hon'ble Supreme Court is that all enough or he need to with draw the appeal in the Hon'ble High Court also ?

when u enter an agreement, it should also be ratified by the high court and it is advisable that he agrees before the high court and then you both file the settlement deed supported by your affidavits in Supreme Court and personally appear before the supreme court to withdraw the petition.
