Legal Question in Family Law in India
Urgent advise required.
i am reposting this question, because i wanted to make some points clear.
i know that i can resort to filing the DVA but unfortunately the courts in chennai are closed for a long time now due to the tamil problems in srilanka.
i need to know if i can have the police come and make them leave?
how do i deal with this until the case is filed?
my husband and i are getting a divorce, which he is asking for. i have agreed to the divorce and the settlement amount has been decided too and we are now looking towards how he can deposit the money etc and when i sign. BTW, he lives in USA. i am in india, chennai. He actually cheated me by saying he would take me to america with him and then just left and is now asking for the divorce. His mother is here and has come over with 10 relatives and is making life very miserable for me. the house i am staying in is his house and i have said that i will leave it once the papers are signed. they have now come and are theatening me, abusing me, not allowing me to use the kitchen or the rest of the house, asking me to stay in one room with all my things and are generally making life very miserable. what can i do? legally what is my position? Thanks for the help.

Hello.
Good Afternoon!
Legally your position will be strong.
I would suggest you to stay with your relatives call them at your place. Do not stay alone.
Call the police if someone is coming to threaten at your place.
Re: Urgent advise required.
you can still approach the protection officer of your area who are appointed by ministry of social justice. you need to file a complaint to the protection officer and she would do the needful.
Re: Urgent advise required.
you can approach a local sr advocate.
Re: Urgent advise required.
(1) Yes, you may request the police to intervene and provide you protection.
(2) They are not allowed to threaten you or abuse you or disturb you in any manner;
(3) Legally, you are in a very strong position.
(4) You may refuse to accede to divorce and in view of the changed situation, you may re-negotiate the entire matter.
(5) It may be possible to negotiate with your husband in USA, if you may so desire.
