wanted to get divorce decree after 11 years divorce9non judicial]
respected sir/mam,i filed a case in city civil court but opposite party didnt remain present so we took non judicial divorce by notary.now after 11 years my case is transfered in family court and i have to remain present.opposite party got married and he would not come in family court.now i want divorce decree.can i get it? do i have to appoint lawyer?or without lawyer can i get divorce decree. i am absolutely blank.please help me for this concern.

u need to appoint a lawyer and he would guide you the legal steps to be taken to get the decree of divorce. a divorce by notary pulic is not valid and till u dont get the decree u a married woman and have all the rights of a married woman and your husband's marriage to the other woman is void in the eyes of law.

if you are well aware of the procedure then you need not appoint a lawyer. You can get exparte decree for divorce.

In a family court it is not necessary to appoint a lawyer and you can get a decree of divorce from the family court. you may move an application for an ex-party decree in your favour if the opposite party is not remianing present before the court.

You may appear personally, make your statement and pursue your divorce. If you can afford to engage a lawyer, that may help.

you can get the decree by fighting the same in the family court but your noterial divorce is not valid.
