if a wife has affair with a boy friend and the husband wants a divorce then is a seperation of one year important and nessesary. the husband has a few telephone recordings audio to prove her guilty

separation of one year is a statutory requirement. however, the husband may move an application for waiving that period.

Yes if you are going for mutual consent divorce separation of one year is necessary. You can file petition for contested divorce anytime after a period of one year from marriage.
