Legal Question in Family Law in India

Hi, Me and my wife has applied for mutual consent divorce in the month of February,2011 and we have to appear before court by this month end for the first motion hearing. And currently i am at onsite and cant make it happen as i will be at onsite for more than one more year. Is there any alternative so that i can go ahead with this mutual consent proceeding. If not this what is the other alternative way.

Dear client, in that case the court will defer the matter for another date since your presence is needed to sign the motion.

the matter in your absence will be adjourned to a future date by the court.

Yes you can give POA to someone in your family to appear on your behalf in 1st and 2nd motion and you would get Decree of Divorce. Your presence may not be required by court in these circumstances.

you can execute a power of attorney if you cannot appear in the court. if you are in india, you need to show the document that you cannot appear before one year.
