Wife has asked for Annulment or Divorce as alternate relief.

Can she get annulment on ground of husband's impotency if she submits her virginity certificate as evidence, and husband remains absent on all dates in court?

What if husband submits his potency sertificate and remains absent on further dates?

Is husband's absence and adverse inference enough to get Annulment?

If u contest the case, case will be decided on merits

If the husband does'nt wish to contest and does'nt appear before the court , the court would be left with no option but decide the matter in his absence . What does husband want ? This is very important to know and to advice accordingly.

annulment cannot be prayed as an alternate relief in the petition for divorce as the annulment needs to be filed within one year of marriage and divorce is filed after one year of marriage.
