Legal Question in Family Law in India

Hi,

My wife has not attended counseling the first time and the case has been postponed to next month for next counseling and I m not sure whether she turns out at that time. What will happen if remain absent for multiple times , sir?

Again , I am not thinking of divorce and I am actually against it, but if she insists on that , will the court rules in her favor, sir, Kindly clarify?

If the case is filed by her for divorce and if she is attending court then the case will be decided against her and dismissed. If you have filed it then you can always ask the court to give you an order exparte in her absence. So in this case when your wife has filed the case and remains absent then you can have the case dismissed and it will be in your favour and against her.

in case she wants to divorce you and there are no children involved, you may choose to accept the situation and agree for divorce in case the alimony is affordable.
