Legal Question in Family Law in India
My wife was a divorcee with one male child aged 7 years at the time when I married her 4 months back. Since the child's natural father is a drunkard and has no livelihood means and used to repeatedly make calls to my wifes number and say ill words so I am planning to file the case for adoption. Since this is affecting me my family and my child what should be done to make that rogue away by law. Any expert suggestion I would be very much thankful to you.
Note " The divorce took place with mutual consent and its only mentioned that the child is with the mothers custody, nothing more other than this is mentioned in the case."

Its good for you and your wife to file a criminal complaint against him for harassment etc.
you need not adopt the child as you already his step father. you may seek other legal remedies.
Agree with Mr Kalra. You may first lodge a report with the local police.
you can file a police complaint as after divorce he is in no way related to your wife and as custody of child is with your wife you needn't worry about adoption
