Legal Question in Family Law in India
My wife filed a divorce case under cruelty grounds upon her parents coercion and undue influence. Her petition stated that she did not live with me even for a single day since the date of marriage and No MangalSutra was tied on her neck during registration of our marriage. My preliminary issue raised against was "When there is no living claimed even for a single day, then Cruelty would not araise. Moreover the date, time and place of cruelties were not found alleged in the petition leading to absence of cause of action". But divorce was granted by the Family Court and I've appealed in the High Court Bench under CMA. Now I have an additional proof of having tied MangalSutra tied on her neck which was submitted to the Registrar of Marriage. Can I take this issue to the notice of Chief Justice of High Court, Supreme Court, President of India stating that Justice is being taken for a ride by my wife and justice is being delayed which has already caused an irrepairable damage to me?
