My wife has filed Domestic violence case against me, my parents & sister.
Court is giving dates every 7 days. I m living in mumbai & case is in Gujarat. i am not able to attend all the dates even my lawyer is from mumbai. What is rule for Giving Ex parta judgement ?

In fact Domestic violence is not a criminal matter. it is a civil remedy. One need not appear in person on every date of hearing, if he is lawfully represented by counsel. For any specific query if the court wants then only appeance is required.
am in agreement with Mr. Arya here. unless the orders of court restraining the respondent are violated, no punitive measures are adopted. hire a good lawyer n defend yourself.
