Legal Question in Family Law in India

My wife has filed an FIR under section 498-A against me i.e his husband, mother in law , father in law , sister in law , brother in law.

we all took anticipatory bail.

In police inquiry police make me accused and other four people in column no 12.

because

my wife has not provided any single evidence or witness statement in support of her case.

My sister has married before eleven years of my marriage

I was staying in separate house than my parents

and only i filled the bail bond in police station and also in court in front of magistrate. and then magistrate give me next date to give the complaint copy and also summon rest of four.

On the very first date without giving any complaint copy magistrate ask all other four to fill bail bond.

its affecting my sisters married life.

can i appeal against this order in the same court in next date or in high court.

Yes you can appeal to the appellate court (sessions Court )and not the court where your matter is pending .

this is the stage for you to argue on discharge of one and all from the case. bail is a formality which the court has to complete after the anticipatory bail. Have patience, follow the procedure, if there are no allegations, you may be discharged here. if not, then, challenge the order.
