Legal Question in Family Law in India
My wife has filed the restitution of conjual rights case after she left the house before two years.I agreed for the restitution of conjual rights in the first hearing.After two years of dragging the case she withdrawl the restitution of conjual rights case now.
But Last year 2010 she has filed another one case the domestic violence case againts me and my parents and asking maintance in this case.
Currently I am unemployed now and i do not have any properties in my name.
we do not have kids also.I am the only son of my parents and no sisters.
My question is

1,Whether my wife have rights to claim my father properites(like land or house) in that case.
pls clarify.

she has no right in your or your father's properties and at the most she can claim maintenance or compensation. as there are no kids involved, there is a little possibility of her seeking the relief where you are restrained from relinquishing your share.
despite the fact she does not have a strong case, try to settle the matter amicably.

no she cannot claim anything from your father's property.
No your wife cannot claim anything from your father for residence or maintenance.
