Legal Question in Family Law in India

My wife has filed the restitution of conjual rigts in 2009 after she left the house.

I agreed for the restitution of conjugal rights.But she did not return back and She dragged the case for two years and finally she withdrew

her petition 2011.

After she withdrew the restitution of conjugal rights case she has filed the maintenance case under crpc 125 in 2011.

She filed the application for interim maintenance by saying lot of false allegations against me.She did file any evidences and not appear for arguments also but the court ordered for interim maintenance for Rs 3000 now without proper enquiry. Even though i accepted her restitution of conjual rights.

Now i am unemployed and four years completed after she left the house.

1,shall i go go for appeal in another court?

2,shall i file the restition of conjual rights case?

you may go for an appeal against the order and in that appeal do mention the fact that you wanted to comply with the orders of RCR and she is staying away from you without sufficient cause and herself withdrew her RCR. this may be a good ground for you in the appeal. you may visit www.karvai.in to know more about maintenance.
