Legal Question in Family Law in India

My wife has filed the restitution of conjugal rights after she left the house.I agreed for the restitution of conjugal rights and asked her to come and join with me.

But she did not return back and She dragged the case for two years and finally she withdrew her petition.

After she withdrew the restitution of conjugal rights case she has filed the maintenance case and filed application for interim maintenance by saying lot of false allegations against me.She did not file any evidences and

not appear for arguments but the court ordered for interim maintenance now without proper enquiry.

1,Shall she have legal rights to claim interim maintenance even though I accepted her conjugal rights

(she is only not interested to come)?

2,Is it possible to get stay for this order in high court?

if you agreed for RCR and it is recorded by the court, you have a strong case against her. read more on matrimonial laws on my website www.karvai.in.
