Legal Question in Family Law in India

The wife is harassing just with the intention to grab my property.she is staying in my home,which is on joint name and i left it last year.
i hv conceded and regularly paying Maintenance to the daughter in DV case at JMFC.I Hve no job now and She left her job and again demanding maintenance to her and the daughter under HAMA. She is not ready to setle the matter amicably and just wants to extract the money from me. On which ground the maintenance could be rejected to her apart from im unable to pay.suggest some citations.thanks

There is hardly any ground to avoid maintenance. Try to reach an amicable settlement.

If you can prove that you have no source of income you may be able to avoid maintenance. Contact a local lawyer with full facts of the case for exact advice.

Under the law ,the Husband is suppose to maintain his family and by saying that you are without a job will not get you out of this imbroglio. If you are able bodied and educated then without a job really wont help you. Try to sort out difference(s) between you and your wife.

in case you do not have a job, you may move an application before the court concerned stating the valid reason of not able to pay the required amount of maintenance.
