Legal Question in Family Law in India

My wife is not with me since 04 Jan 2011. Reason - we had a fight on my aunty's health( She had blood cancer) as i asked her to leave her job for a time being to take care of my aunty with whom we are living. Since than I had tried a lot to bring her back to home but due to her father's pressure she won't come saying that she want to come back but not secure for future.I went twice to her father's home with my uncle and friends and call so many times to settle dispute amicably but her father always says that he needs 6 to 8 month to think and not want to do anything in hurry. I filed a case in Women Cell but she had not came their. Now I sent her notice through my lawyer. Shall I go for RCR? What are the chances to have decree of RCR in my favour?

Hi,

Yes if you go for RCR, decree will come in your favour. But I would suggest, try settling this matter outside the Court. Don't forget, she is your wife not your servant. Why shall she leave job for someone else? In this case better appoint some care taker who will take care of ur Aunt. Better apologize and start leaving together some where else. You both are matured enough, so hope you come down to some amicable solution.

RCR is the only option in these circumstances which you have mentioned . The chances are bright for you to get the Decree and more over you will come to know why she has withdrawn from your society maybe you'll mend ways too.

that will be better .don't send lawyer notice, in my experience after getting the notice your wife may file criminal case against you. if yo prove your case you may get the decree
