Legal Question in Family Law in India

Hi,

My wife and I am leaving seperately. This december it will be 2 years to our marriage. She is living with her parents from the past 10 months along with our son who turned 1 year this month.

My question is can my wife file an 498 case against me staying in her parents house??

She keeps on sending me abusive smses and to which I reply that I will fight for custody of my son. Can she take this as an excuse for filing 498 against me??

If she goes to police what will be the outcome?

My friend it is not possible to predict what she will do OR what she can do. But yes you can do something in order to protect yourself.
