Legal Question in Family Law in India

My wife married to any other guy without obtaining divorce and claims very high maintenance in court i submit the affidavit in court in this regard. can court may order to investigate her second marry? i can demand from the court to investigate the matter by CBI, Police or any other investigation authority.

the CBI would not investigate the case and you need to file a complaint for bigamy in the court of CMM and lead evidence to this effect. do you have a proof that she got married to another guy during subsistence of her marriage with you. in case you have the proof, even her maintenance order may go.

You may need to prove that she is living with other man. however, she may still be entitled to maintenance under Hindu Law.
