Legal Question in Family Law in India

My wife is a mental patient and is currently in rehabilitation center . My father in law who is presently in custody of my child has refused to come to court and I am planning to file Habeas Corpus for the custody of my child in Bombay High Court. He has not accepted the lawyers pvt notice sent to him to appear for the first hearing. What will the court do in this case.

Will my time be wasted if the respondent in this case does not accept court notice nor appear in court?

How will the court give judgement in this case as I need my child custody very urgently.

in case he has not accepted lawyers notice, you may file a petition for custody and there are other means of service of notice. you can file the petition only in the jurisdiction where you child is staying.
